IMPORTANT MVP NOTICE: This is a Minimum Viable Product (MVP) version of Bloomence AI Scribe. This service is currently in development and is NOT intended for production use with real Protected Health Information (PHI) or personal health data. By using this service, you agree to use only synthetic or example data during this testing phase.

1. Acceptance of Terms

By accessing or using Bloomence AI Scribe ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Bloomence AI Scribe is an AI-powered therapy documentation platform that provides:

Audio transcription services for therapy sessions
AI-generated clinical notes in various formats (SOAP, DAP, BIRP, GIRP)
Session management and organization tools
Secure data storage and management

        Current Status: This is an MVP version. Full HIPAA and PIPEDA compliance features are in development and will be available in future releases.
    

3. User Accounts and Registration

3.1 Account Creation

To use the Service, you must:

Provide accurate and complete registration information
Maintain the security of your account credentials
Be at least 18 years of age
Be a licensed mental health professional or authorized user

3.2 Account Responsibilities

You are responsible for:

All activities that occur under your account
Maintaining the confidentiality of your password
Notifying us immediately of any unauthorized use
Ensuring your account information remains current

4. Acceptable Use

4.1 Permitted Uses

You may use the Service to:

Create and manage therapy session documentation
Generate clinical notes using AI assistance
Store and organize session data securely

4.2 Prohibited Uses

You may NOT use the Service to:

Process real Protected Health Information (PHI) during MVP phase
Violate any applicable laws or regulations
Infringe on intellectual property rights
Transmit malicious code or harmful content
Attempt to gain unauthorized access to our systems
Use the Service for any illegal or unauthorized purpose
Reverse engineer, decompile, or disassemble the Service

5. Data and Privacy

You retain ownership of all data you input into the Service. We do not claim ownership of your content.

Note generation using AI models

7. Payment and Billing

During the MVP phase, the Service is provided free of charge for testing and development purposes.

We reserve the right to introduce paid plans in the future. Users will be notified of any pricing changes with at least 30 days' notice.

7.3 Payment Terms

When paid plans become available:

Fees are billed in advance on a monthly or annual basis
All fees are non-refundable unless otherwise specified
We may change pricing with 30 days' notice
Failure to pay may result in service suspension

8. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

AI-generated notes and transcriptions are provided for assistance only. You are responsible for reviewing, editing, and approving all AI-generated content before using it in professional practice.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
